North Carolina Real Estate Probate Agents – What You Need to Know Before You Sell

Written by Posted On Saturday, 30 September 2017 05:18

If you’ve recently lost a loved one and been left a property in the will, this can be a difficult time. In most cases, many people will want to sell the house quickly for emotional reasons or to avoid high maintenance costs.

However, selling a home in North Carolina in probate is different and more complex than selling a traditional property. It is therefore important to have an experienced North Carolina probate real estate probate agent to guide you through the process.

What is a probate?

Probate is a legal process of winding up a deceased’s financial, tax and other aspects of their personal life. It is also oftentimes called estate administration.

Typically, a probate is required whether there was a Will or not. If the deceased person has left a will, one or two persons will usually be named in the will to act as the will’s executor.

If you are named as one of the executors, you may be required to apply for probate.

If the property was owned in the sole name of the deceased, the executors will not be able to sell or transfer the property without a grant of probate. This is issued by a section of the court known as the probate registry.

However, if the title deeds show that the property was in the joint ownership of the deceased person and a surviving person, it can be sold without the grant of a probate.

What should I expect in a probate sale?

The process of selling real property through probate follows a series of court-regulated steps. Each step must be carefully monitored and managed because deadlines are unforgiving.

In a probate sale documentation is specialized. In addition, the court’s oversight must be honored throughout the entire process including marketing, offers, negotiations, and sale of the property.

Aside from the personnel of the court, a probate sale typically involves the Executor, the attorney representing the estate, and a real estate agent representing the seller. There are also one or more buyers who place bids with court and the buyers’ real estate agents. These individuals are expected to follow the guidelines and deadlines set by the court.

Unlike other real estate transactions, probate and trust sales have a vocabulary all their own, mainly due to the involvement of the court. There are also a number of disclosure documents and contracts not usually used in other home sales.

If you are selling a real property through probate, you need a real estate agent experienced in probate and trust sales. Your real estate agent should also be familiar with the language, the documentation, and the steps involved in the process of a probate sale.
