Businesses are all about profit, and the lesser the loss margin is, the better. However, some unpaid debts can be a massive loss to the companies. These debts can be counted in the category of damages in a business and hence needed to be resolved.

There was a time when these unpaid debts could have cost much, and thus, the corporate world required a way to sort out these problems. However, the increasing number of debt collection agencies have made this task of collecting the debts easier. Now a creditor (the person who lends the money) hires a debt collection agency for this purpose.

A debt collection agency is an agency which helps a creditor to accumulate the due debt owed by the creditor. The debtor and creditor both communicate through the agency. Thus the agency works as the middleman between both of them.

The creditor can be a corporation, a business, or even an individual. The debtor might be another individual or corporation. An agency properly scrutinizes both the party situation and work accordingly. The creditor should have complete documentation or proof of the debt; then only the agency can help with the mortgage.

We will get to know now that what the process that every debt collection agency follows is. The article tells how every debt collector and every debt collection works. What is the procedure that is followed in every agency? So if you are a debtor and gets a call from a debt collector agency, you will know all about it. Alternatively, if you are a creditor and waiting for your owed cost, then you should follow this specific process.

Followed path by debt collection agencies

Approximately 30 million Americans have at least one debt in collection, and thus it increased the need for a debt collector agency. Hence with this large about of numbers to control, debt collection agencies follow an easy five steps process. These steps are:

  1. 1.The creditors' contact agency

The very first step is that when a creditor had been waiting for a long time and still didn’t receive the due amount, and contacting the debtor is not working in any way, or it is becoming impossible to locate the debtor, they must then contact a debt collector agency. By doing so, they can ask the agency to work for them and collect the debt on their behalf.

The agency will take the case in its hands now. The debt collected afterward will belong rightfully to the owner, and the agency will get their compensation. However, in some cases, the creditor decides to let off the debt and sell it to the agency, as they think the debt is taking too much time or is not worth it. In this case, when the debt is later on collected, it justly belongs to the agency.

  1. 2. Complete information about debt is taken

The 2nd step comes then when the agency takes full details on the debt owed. The first thing they ask is the amount of the mortgage. The debt cannot be of a tiny amount. Such debts are often rejected. However, in some cases, they can be selected as they are easy to handle. Most agencies prefer more significant deficits.

They take complete information of the debtor (the information provided to the creditor). They also try to find out more data about the debtor. Then they try to understand the whole situation, which includes when and how was the money advanced, what were the terms and conditions, and why is it still in the process.

  1. 3. Written letter request sent to the debtor

The third step is the formal and co-operative method for settling the debt without any strict actions involved. A simple, formal request is sent to the debtor with the complete information about the debt. The debtor is asked, formally, to pay the debts or the matter must be taken to court.

If the debtor and the agency settle the money owed through this letter, then there will be no need to take any action further. However, this letter can be ignored, neglected, or not taken seriously. Unfortunately, the events take an ugly turn from here.

  1. 4. Legal action

When the debtor doesn’t collect the written request, the collector takes the next harsh step. That is, the debt is taken to court. An attorney representing the agency and the creditor will file a suit against the debtor. As soon as you get a court notice, you must appear on the date or else you would have to pay the debt, no matter how much.

In court, both the parties can put forward their points, and the judgment will be based on these facts discussed. If the court orders the debtor to pay the debt or set a certain amount of debt to be paid, it will also grant the debtor at least 30 days. During these days the debtor can re-appeal in court. However, otherwise, they will have this time to pay and clear the debt.

  1. 5.Second legal action

When the debtor does not reimburse the debts regardless of the court order, then a second legal action is taken. This is the final step in which the collector can collect the debt. This time the debtor will get an execution order by which any account or property is seized.

Land or property of the debtor can also be possessed until the debt is cleared. This will lawfully belong to the creditor or the collector till the dues are cleared. Hence, the debtor has no other choice but to pay their dues. The collector agency then passes the payment to the rightful owner and receive their commission. Alternatively, if the debt belongs to them, then they can keep it officially.

Hence these are the five steps that can be taken. However, before contacting an agency, you should first take some other measures so that disputes can be solved among the debtor and the creditor.

Unlike informal agencies that forcefully collect debts, a reputed debt collection agency follows a formal path. This means that they cannot be violent, unfair, dishonest, disrespectful, or unlawful. They have to be careful.
